LAKE COUNTY SUPERIOR COURT RULES

Chapter 1 - Introduction

1.1 Adoption of Rules

These rules are adopted pursuant to Government Code  §68070 and Code of Civil Procedure  §575.1 and each is effective on the date set forth in parenthesis immediately following the rule, e.g., "(eff. 1/1/92)". (eff. 1/1/92)

1.2 Repeal of Prior Rules

Upon the effective date of these rules, all other rules heretofore adopted by this court shall be repealed, provided that no action theretofore taken in compliance with such rules shall be made or deemed invalid or ineffective by such repeal. (eff. 6/30/91)

1.3 Availability of Copies

Copies of these rules are available in the office of the clerk of the court, Courthouse, Lakeport, California 95453. (eff. 6/30/91)

1.4 Sanctions for Non-Compliance

Pursuant to Code of Civil Procedure  §575.2, if any counsel, a party represented by counsel, or a party if in pro se, fails to comply with any of the requirements of these rules, the court, on motion of a party or on its own motion, may strike out all or any part of any pleading of that party, or dismiss the actio or proceeding or any part thereof, or enter a judgment by default against that party, or impose other penalties of a lesser nature as otherwise provided by law, and may order that party or his or her counsel to pay to the moving party the reasonable expenses in making the motion, including reasonable attorney fees. In addition, sanctions authorized by Code of Civil Procedure  §128.5,§ 177.5 and §178 may be imposed. (eff. 1/1/92)
